testimony has now "converted" Hammond into an "employee". Can you believe
that a jury bought this perjured testimony and the very DA who prosecuted
the case was too inept to catch the contradictions? Or, did not want

Most notably, Mr. Fling points out facts indicating that the "Application
for Consent to Transfer", which is REQUIRED BY FEDERAL LAW to be filed
PRIOR TO A TRANSFER OF CONTROL, was filed more than a month AFTER the
TRANSFER OF CONTROL WITH THE STATE OF TEXAS in 1999. Mr. Fling also
indicates that Steven Emmert - the Judge who signed the original
indictment of Hammond that was later amended by the district attorney to
indicate otherwise and to read differently - was listed as PRESIDENT of
the corporation claiming ownership of the radio station. Mr. Fling also
provides testimony indicating that he had worked in communications
law "prior to 1979" and has been "out of that field since that time" when
the field has changed COMPLETELY since 1996! Can you believe
that a jury bought this testimony and the very DA who prosecuted
the case was too inept to catch the contradictions? Or, did not want
to catch the contradictions...

transferring control of the radio station three years prior to Hammond's
arrival.

Mr. Rushing (and his cohort in crime, Ms. Switzer) seem to take some
perverse pride in bragging about unlawfully breaking into the computer
systems of the radio station with stolen passwords. Of course, Switzer
goes way overboard in her arguing and objecting to anything and everything
that might show that what is happening is that Rushing is making bold
confessions to federal computer crimes. Can you believe
that a judge bought this testimony and the very DA who prosecuted
the case was too inept to catch the contradictions? Or, did not want
to catch the contradictions... (Haven't we said this before? Oh... It must
be a pattern!)

This document consists of copies of Hammond's original documents in which he assumed control of the radio station, a copy of the original criminal indictment, copies of each and every check Mr. Hammond was accused of stealing from "David Rushing".
Please note that the original agreement between Mr. Hammond and Mr.
Turvaville was signed, witnessed and notarized on February 2, 2002. The
date the contract went into effect was listed as March 10, 2002. (This was
due to the Jersey Boy's original agreement to remain in Shamrock until
March. However, at the last minute and after this agreement was drawn and
signed, the Jersey Boys left very much earlier, thereby forcing Mr.
Hammond to assume operation of the station several weeks earlier than
originally planned.) However, you will also note that, of all of the
checks Mr. Hammond was accused of stealing, each and every one was dated,
deposited and/or cashed more than a month after March 10th, 2002. That
date (March 10, 2002) is the latest possible date on which Mr. Hammond can
be considered to have assumed any and all rights to the receivables of the
radio station. At no time, after March 10, 2002, has any person other than
Terry Keith Hammond had any legal rights to any income generated by and/or
through the radio station (under any name) in Shamrock, Texas. Just as a
laugh, you may also want to note that the original indictment of Mr.
Hammond - that was later amended (in violation of state and federal law) by the
assistant district attorney and with the blessings of Judge John Forbis -
indicated that Mr. Hammond had stolen "United States Currency" from "David
rushing, the owner thereof". Another side note is that the original
indictment proudly bears the signature of the "drug-dealing DA", Richard
James Roach who is now serving both state and federal prison sentences
due to his confessed involvement with illegal drugs and firearms.
